These Terms and Conditions (the “Terms”) set out the rules for accessing and using flexorbit.net (the“Website”), operated by FLEXORBIT LTD. Please read them carefully before using the Website.

Definitions

“Company” (also “we”, “us” or “our”) refers to FLEXORBIT LTD, a company registered in the Republic of Cyprus under registration number HE 474315, with its registered address at A5, A.G. LEVENTI, THE LEVENTIS GALLERY TOWER, 13th Floor, Apt. 1301, 1097, NICOSIA, Cyprus. The Company is the legal owner and administrator of the Website and its content, which it operates to present its software development services.
Service
Refers to the Website and the information about the Company and its software development services that it makes available.
Website
Refers to flexorbit.net and its sub-pages, which contain information about the Company and the software development services it offers.
Device
Any device that can access the Service, such as a computer, tablet or mobile phone.
You
The individual accessing or using the Service, or the company or other legal entity on whose behalf that individual is acting.

Any content, service or resource provided by a party other than the Company that may be linked from or displayed within the Service.

These Terms govern your use of the Website and form the agreement between you and the Company in relation to that use. They apply to every visitor to the Website.

The content, information and services made available through the Website are provided “as is” and “as available”, with all faults and without warranty of any kind. To the maximum extent permitted by law, the Company disclaims all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Without limiting the foregoing, the Company makes no representation or warranty that: (i) the Website will be available, uninterrupted or error-free; (ii) the information or content it provides is accurate, reliable or current; or (iii) the Website, its servers or communications sent from it are free of viruses or other harmful components.

These Terms, and your use of the Website, are governed by and construed in accordance with the laws of the Republic of Cyprus, excluding its conflict-of-law rules.

If you have any concern or dispute regarding the Website, you agree to first attempt to resolve it informally by contacting the Company.

Any dispute that cannot be resolved informally and that relates to these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Cyprus.

You agree to indemnify and hold harmless the Company and its affiliates, directors, officers, employees, agents and licensors from and against any liabilities, losses, damages or costs, including reasonable legal fees, arising from any third-party claim relating to your use of the Website or any breach of these Terms on your part.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified and interpreted to achieve its objective as far as possible under applicable law, and the remaining provisions will continue in full force and effect.

The failure of the Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision, nor a waiver of any subsequent breach.

The Website may be used only for lawful purposes. You must not use it:

  • in any way that breaches any applicable local, national or international law or regulation;
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • to harm or attempt to harm minors in any way;
  • to transmit or procure the sending of any unsolicited or unauthorised advertising or promotional material (spam);
  • to knowingly transmit any data or upload any material that contains viruses, trojan horses, worms, spyware or any other harmful programs or code designed to adversely affect the operation of software or hardware.

You also agree not to reproduce, duplicate or resell any part of the Website in breach of these Terms, and not to access without authority, interfere with, damage or disrupt any part of the Website, the equipment or network on which it is hosted, or any software, hardware or network owned or used by any third party.

We may suspend or terminate your access to the Website immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Website will cease immediately.
